These terms are the agreement between you and Cryptain ("Cryptain", "we", "us"). They cover your Cryptain account and everything you use through it: the dashboard, hosted checkout pages, invoices, payment links, buttons, the point-of-sale page, the API, plugins and SDKs (together, the "Service"). By creating an account or using the Service you accept these terms. If you accept them for a business, you confirm that you can bind that business.
They work together with our Privacy Policy, Acceptable Use Policy, AML and Identity Policy, Risk Disclosure, Refunds and Cancellations, Complaints and Cookie Policy. Where they conflict, these terms win.
1. What Cryptain does
Cryptain is software that lets a business (the "Merchant") ask its customers (the "Payer") for a payment in cryptocurrency, detects that payment on the blockchain and tells the Merchant's systems about it. Each store chooses how payments settle:
- Balance settlement. The Payer sends funds to an address we control. Once the payment is confirmed we credit your Cryptain balance with the amount received, less our fee, in the same cryptocurrency. You withdraw to a wallet you choose.
- Own-wallet settlement. The Payer sends funds straight to an address that belongs to you, generated from a public key you give us or taken from a list you provide. We never hold these funds and never see your private keys.
We are not a bank, an exchange, a broker or an adviser. We do not convert cryptocurrency into government money, we do not pay interest on balances, and balances are not deposits protected by any government guarantee scheme.
2. Your account
- You must be at least 18 and use the Service for a genuine business, trade or profession, including as a sole trader or freelancer. It is not for personal savings or transfers between friends.
- The information you give us must be true and kept up to date. We may ask you to verify your identity and your business at any time, as described in the AML and Identity Policy.
- You are responsible for everything done through your account, including by team members and with your API keys. Keep passwords, two-factor devices, API secrets and webhook secrets private. Tell us at support@cryptain.net straight away if you think any of them has been exposed.
- You may not open an account if you, your business or the people who own or control it are subject to sanctions, or are located in a country or region where we cannot lawfully serve you.
3. Stores and approval
Each website, app or shop you take payments for is a store. We may review a store before it takes live payments and at any time afterwards. We may decline or pause a store whose business is not allowed under the Acceptable Use Policy, or where we cannot understand what is being sold.
4. How a payment works
- Price and rate. You set prices in a supported currency. When the Payer chooses a coin, we calculate the crypto amount from our current rate and hold it for the invoice's payment window.
- Confirmations. A payment counts once the blockchain has the number of confirmations we require for that network. Until then it can still fail or be reversed by the network.
- Exact amounts. The Payer must send the exact amount, on the network shown, before the window closes. Your store settings decide what happens to underpayments, overpayments and late payments. The invoice records what actually arrived.
- Wrong coin or network. Funds sent on the wrong network or in an unsupported token may be impossible to recover. Where recovery is technically possible we may attempt it, but we are not obliged to, and we may charge for the cost.
- No reversals. Blockchain transactions are final. There are no chargebacks. Refunds are new transactions that you choose to send.
5. Balances and withdrawals
- Your balance is a record of the cryptocurrency we hold for you, not a loan to us. We keep merchant funds separate from our own operating funds in our records.
- Withdrawals go only to addresses saved in your account. New addresses may be locked for a short period before first use. We may require two-factor confirmation, identity checks or a review before sending.
- Each withdrawal pays the blockchain network fee shown before you confirm it. Minimum amounts may apply.
- We may delay or refuse a withdrawal if we reasonably suspect fraud, a breach of these terms, a sanctions issue or other illegal activity, or if the law requires it. Where the law allows, we will tell you why.
- Check addresses carefully. A withdrawal sent to an address you saved cannot be recalled.
6. Fees and plans
- Fees and plan prices are shown on the pricing page and in your dashboard. The fee for a payment is the rate on your plan at the moment it is credited.
- For balance settlement, we take our fee from the payment before crediting your balance. For own-wallet settlement on plans that charge a fee, we may invoice you separately.
- Paid plans are bought in advance for a month or a year and do not renew by themselves. When a plan ends, your account moves back to the free plan.
- We may change fees with at least 30 days' notice by email or in the dashboard. Changes do not affect payments credited before they take effect.
- You are responsible for your own taxes, including tax on the payments you receive.
7. Your obligations to your customers
You are the seller. You are responsible for your goods and services, your prices, your own terms, delivery, refunds, consumer law and the taxes that apply to your sales. You must not suggest that Cryptain sells, guarantees or endorses what you sell. Customer complaints about an order are yours to resolve.
8. API, plugins and integrations
- We grant you a non-exclusive, revocable licence to use the API, plugins and SDKs to connect your stores to the Service while your account is open.
- You must verify webhook signatures and confirm payment status before releasing goods. We are not responsible for losses caused by an integration that trusts unverified data.
- Rate limits apply. Do not try to bypass security controls, test the Service for vulnerabilities without permission, or use it to build a competing service.
9. Suspension and closing
You can close your account at any time once your balance is withdrawn. We may suspend or close an account, a store or a feature, with notice where possible, if you breach these terms, if we are required to by law or a regulator, if your account creates risk for other users or for us, or if it stays inactive for a long period. When we close an account we will let you withdraw any balance we are allowed to release, after deducting amounts you owe us.
10. Availability and changes to the Service
We work to keep the Service running, but blockchains, rate providers, hosting and other networks are outside our control, and maintenance is sometimes needed. Current status is shown on the status page. We may add, change or remove features. If we remove something you pay for, we will give reasonable notice.
11. Liability
- The Service is provided "as is". Except where the law says otherwise, we give no promise that it will be uninterrupted or error-free, or that it is fit for a particular purpose.
- We are not liable for indirect or consequential loss, lost profits, lost business, changes in cryptocurrency prices, network failures, forks, or funds sent to a wrong address, network or token.
- Our total liability to you for any claim is limited to the fees you paid us in the three months before the event that caused it.
- Nothing in these terms limits liability that cannot legally be limited, such as for fraud.
You agree to compensate us for losses we suffer because of your breach of these terms, your sales, or your breach of the law.
12. Intellectual property
The Service, its design, software and brand belong to us or our licensors. You keep ownership of your content, logos and data. You give us permission to use them to provide the Service, for example to show your logo on your checkout page.
13. Changes to these terms
We may update these terms. For changes that affect your rights we will give at least 30 days' notice. If you keep using the Service after a change takes effect, the new terms apply. If you do not agree, you can close your account before then.
14. Law and disputes
These terms are governed by [your jurisdiction]. Before taking any formal step, please use the process in our Complaints Policy; most issues are solved there. If that does not settle it, the courts of that jurisdiction will decide, unless the law where you are gives you a right to go to your local courts.
